These Terms and Conditions (“Terms”) govern your use of Artfone® websites, devices, services, applications, and customer support (“Artfone® Products and Services”).
Please read these Terms carefully before using Artfone® Products and Services. By accessing or using any part of the Artfone® ecosystem, you agree you have read, understood, and accept all Terms stated here. If you do not agree with all Terms, do not use Artfone® Products or Services.
These Terms constitute an agreement between you and Artfone Ltd., a UK company.
Using Artfone® Products and Services
You must follow all policies and procedures applicable to Artfone® Products and Services. This includes:
- Complying with posted instructions, terms, and notifications
- Obeying local, state, national and international laws
- Respecting all intellectual property and proprietary rights
We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use Artfone® Products and Services. Our products and services are intended for your personal, non-commercial use only.
Artfone® Accounts
You may need an Artfone® account to use some services. You agree to:
- Provide accurate information when creating an account
- Keep your login credentials confidential
- Promptly update any account changes
- Use appropriate security to prevent unauthorized access
- Take full responsibility for all account activities
- Contact us immediately if you suspect unauthorized use
Accounts are non-transferable. They cannot be shared, sold, gifted or willed to others.
Ordering Artfone® Products
When ordering on Artfone® websites or mobile applications:
- Product pricing and availability are subject to change.
- Your order constitutes an offer to purchase, which we have discretion to accept or reject.
- Delivery dates provided are estimates only.
- You must provide a valid shipping address and contact information.
- Payment authorizes charges to your account plus applicable taxes and fees.
- All sales final for electronic gift cards or redemption codes.
Purchases may be subject to shipping, taxes, and other fees as notified at checkout or in these Terms. You are responsible for paying these costs.
Returns and Refunds
Purchases made directly from Artfone® may be eligible for return or refund. Approved returns must be undamaged, unused, unaltered, and in original packaging. Refunds subject to the following:
- Devices – 14 day return period. 20% restocking fee applies.
- Accessories – 30 day return window.
- Opened software is not returnable.
- Gift cards/redemption codes are not eligible for refunds.
- Shipping and handling fees are not refunded.
Return requests made outside the designated period will be denied. We reserve the right to refuse refunds that do not meet return requirements.
Payment Terms
You authorize Artfone® and its service providers to store payment information and process charges for orders, subscriptions, and services. This may involve:
- Initial and periodic authorization holds to validate payment methods
- Charges for order amount plus applicable fees/taxes
- Recurring billing for ongoing subscriptions and services
- Using payment details for any outstanding balances
We may update payment details using information provided by payment service partners. By providing payment information, you confirm you are authorized to utilize the payment method.
Taxes
You must comply with all applicable tax laws in connection with use of Artfone® Products and Services, including reporting and paying appropriate taxes. We are not obligated to determine whether taxes apply or calculate, report or remit taxes to any authority.
Artfone® Services
Use of Artfone® services like mobile applications, software, or support services is governed by these Terms plus any additional terms provided for the specific service. This includes both free and paid services.
Subscriptions: Ongoing paid services may require a subscription with recurring billing. You authorize these charges until you cancel. Cancel anytime to stop future billing. We will notify you of price changes to subscriptions.
Trials: Free or discounted trial offers must be used within the stated timeframe. At the end of the trial, standard pricing will apply. You must cancel prior to the end of the trial period to avoid subscription fees.
Termination: We may terminate your access to any services at any time if you violate Terms. Service cancellations by you or Artfone® will not entitle refunds for unused periods.
Artfone® Devices
Compatibility: Artfone® devices are designed to work on carrier networks and with Artfone® services referenced in that device’s product description. However, full compatibility with all systems is not guaranteed. Performance varies based on device capabilities, network technology, coverage, and other factors.
Firmware: Your device may download firmware updates automatically or prompt you to install them. These updates provide new features, bug fixes, service enhancements and are required to continue using your device and associated services safely.
Data Backup: You are solely responsible for backing up data stored on your device including contacts, photos, or other content. Resetting devices to factory settings may erase data. Artfone® is not liable for any data loss.
Intellectual Property Rights
Artfone® Products and Services are protected by copyright, trademark, patent, and other intellectual property (“IP”) laws. All website content, applications, services, products, trademarks, logos, brand names, and other IP are the property of Artfone Ltd. and our licensors.
You may not modify, distribute, reproduce, republish, transmit, publicly display, sublicense, commercially exploit, create derivative works from, transfer, sell or re-sell any Artfone® IP in any way not expressly permitted by Artfone®.
Privacy Practices
Use of Artfone® Products and Services is also subject to Artfone® Privacy Policy. You agree to the collection, use and sharing of your data according to those terms. Please review the Privacy Policy to understand our practices regarding personal information.
Disclaimers
No Warranties: Artfone® Products and Services are provided on an “as is” and “as available” basis without warranties of any kind. We expressly disclaim all warranties, obligations, representations or conditions not stated in these Terms.
No Liability for Third Parties: Artfone® has no control over and is not liable for the products, services, actions or inactions of third parties like affiliates, advertisers, app developers or wireless carriers. We are not responsible for any harm related to your dealings with third parties.
Limitation of Liability: Under no circumstances is Artfone® liable for any incidental, indirect, special, punitive or consequential damages arising out of or related to use of Artfone® Products and Services. Our total liability for damages is limited to the amounts paid to us by you during the prior one month period.
Indemnification
You agree to defend, hold harmless, and indemnify Artfone® from any claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys fees) that arise from:
- Your breach of any portion of these Terms
- Your misuse of Artfone® Products or Services
- Any harm you cause to third parties
Modifying Terms
We may modify these Terms from time-to-time and recommend you revisit them periodically. Updated Terms become effective when posted. Your continued use of Artfone® Products and Services constitutes acceptance of the updated Terms. If you do not wish to accept the new Terms, you must immediately stop using Artfone® Products and Services.
Dispute Resolution
Every effort will be made to resolve disputes through prescribed complaint processes. If matters remain unresolved, all disputes arising out of or relating to these Terms (“Disputes”) shall be referred to and finally resolved through binding arbitration conducted by the London Court of International Arbitration (“LCIA”) in accordance with LCIA rules. The seat of arbitration shall be London. The language of the arbitration shall be English.
Governing Law
These Terms and the relationship between you and Artfone® will be governed by the laws of the United Kingdom without regard to conflicts of law provisions. You and Artfone® agree to submit to the personal and exclusive jurisdiction of the courts located in London, UK.
